Terms & Conditions

These Terms & Conditions ("Terms") govern your use of giftreat.app and any private beta, waitlist, or related services offered by Giftreat Inc. ("Giftreat," "we," "us"). By using the site or requesting an invite, you agree to these Terms. If you do not agree, please do not use the site.

Private beta

Giftreat is in private beta. Features, names, availability, and pricing may change or be withdrawn at any time. Joining the waitlist does not guarantee an invitation, access to the app, or any particular feature, and we may limit or end the beta at our discretion.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to request an invite or use Giftreat. By using the site you confirm that you meet this requirement.

Using the site

You agree to use the site lawfully and to provide accurate information. You agree not to misuse the site, attempt to disrupt or gain unauthorized access to it or its systems, scrape or copy it in bulk, submit false or misleading requests, or use it to harass others or send unsolicited messages.

Gifts, retailers, and third parties

Giftreat helps people share the gifts they would like to receive and connects them with retailers and delivery partners. Retailers and delivery platforms are independent businesses. Their products, prices, availability, delivery, returns, and policies are theirs, and we are not responsible for them. Gift details shown on our site are for illustration and are not offers to sell. Any further terms for purchases or payments will be provided before those features launch.

Retailer partnerships

Submitting a retailer application does not create a partnership, exclusivity, or any obligation for either side. Terms for programs such as Sponsored Discovery and Enabled by Giftreat™ will be set out in a separate written agreement.

Intellectual property

The site, its text, design, graphics, software, and brand names are owned by Giftreat or its licensors and are protected by intellectual property laws. Giftreat, Gift List™, Daily Vibe™, Dream Gifts™, Gift Guru™ and Enabled by Giftreat™ are marks of Giftreat. Some of our technology is the subject of pending patent applications. You may not use our marks, content, or technology without our written permission, other than to view the site for personal use.

Feedback

If you send us ideas or suggestions, you allow us to use them without payment or obligation to you.

Disclaimers

The site and the beta are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Giftreat and its owners, officers, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or the beta. Our total liability for any claim relating to the site or the beta is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

Indemnification

You agree to defend and hold Giftreat harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the site or your violation of these Terms.

Termination

We may suspend or end your access to the site or beta at any time, including for violating these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maryland, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms as Giftreat grows. The effective date above shows the latest version, and continued use of the site means you accept the updated Terms.
